1. Acceptance of Terms

By accessing and using the Pliant Embed Builder service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms apply to all users of the service, whether registered or not. If you do not agree to these terms, you must immediately discontinue use of the service.

Pliant reserves the right to modify, update, or change these terms at any time with or without prior notice. Continued use of the service after such changes constitutes acceptance of the modified terms. It is your responsibility to review these terms periodically.

2. Service Description

Pliant Embed Builder is a web-based application that allows users to create and send plain and embedded messages to Discord channels via webhook URLs. The service provides tools for designing, customizing, and managing Discord embeds.

The service is provided on an as-is basis. We strive to maintain high availability and reliability, but we do not guarantee uninterrupted or error-free service.

3. User Accounts

3.1 Account Creation

To access certain features of the service, including saving embeds, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your password
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

You must be at least 13 years of age to create an account and use this service. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these terms.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these terms. You may delete your account at any time through your profile settings. Upon account deletion, all saved embeds and associated data will be permanently removed.

4. Acceptable Use Policy

You agree to use the service only for lawful purposes and in accordance with these terms. You specifically agree not to:

• Use the service to send spam, malicious content, or unsolicited messages
• Violate any applicable laws, regulations, or third-party rights
• Abuse, harass, threaten, or intimidate others through messages sent via the service
• Send content that is defamatory, obscene, pornographic, or otherwise objectionable
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Interfere with or disrupt the service or servers or networks connected to the service
• Attempt to gain unauthorized access to any part of the service or other accounts
• Use the service to distribute malware, viruses, or other harmful code
• Violate Discord's Terms of Service or Community Guidelines
• Use automated systems or bots to access the service without authorization
• Attempt to reverse engineer, decompile, or extract source code from the service

5. Discord Integration

This service utilizes Discord webhooks to send messages. By using this service, you acknowledge that:

• You are responsible for obtaining and maintaining valid webhook URLs
• You must have proper authorization to use any webhook URL you provide
• You are solely responsible for the content of messages sent through webhooks
• You must comply with Discord's Terms of Service and API Terms
• We are not responsible for any issues arising from Discord's service or API

6. Content Ownership and Rights

6.1 Your Content

You retain all ownership rights to the content you create using the service. By using the service, you grant us a limited, non-exclusive, royalty-free license to store and process your content solely for the purpose of providing the service.

6.2 Our Content

All intellectual property rights in the service, including but not limited to design, layout, software, and branding, are owned by Pliant or our licensors. You may not copy, modify, distribute, or create derivative works based on our content without explicit written permission.

7. Privacy and Data Protection

Your use of the service is also governed by our Privacy Policy, which is incorporated into these terms by reference. By using the service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

8. Limitations of Liability

To the maximum extent permitted by law, Pliant and its owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the service
• Any conduct or content of any third party on the service
• Any content obtained from the service
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all damages exceed the amount of one hundred dollars ($100) or the amount you have paid us in the past twelve months, whichever is greater.

9. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that:

• The service will meet your specific requirements
• The service will be uninterrupted, timely, secure, or error-free
• The results obtained from the use of the service will be accurate or reliable
• Any errors in the service will be corrected

10. Indemnification

You agree to indemnify, defend, and hold harmless Pliant, its owners (MoeBibby and Oukia), officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use of the service
• Your violation of these terms
• Your violation of any rights of another party
• Content you send through the service

11. Rate Limiting and Fair Use

We implement rate limiting to ensure fair use of the service and comply with Discord's API requirements. Excessive use or abuse of the service may result in temporary or permanent restrictions on your access. We reserve the right to determine what constitutes excessive use at our sole discretion.

12. Third-Party Services

The service may contain links to third-party websites or services, including Discord. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party services.

13. Intellectual Property Infringement

We respect the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact us at support@pliant.bot with detailed information about the alleged infringement.

14. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pliant operates, without regard to its conflict of law provisions.

17. Entire Agreement

These terms, together with the Privacy Policy, constitute the entire agreement between you and Pliant regarding the use of the service and supersede all prior agreements and understandings, whether written or oral.
